good evening and welcome thank you so much for joining us my name is Kathleen Kelly and I'm the director of alumni in Legacy giving and this is one of many educational webinars that are presented by Mater Dei High School we're so glad that you guys could be here insight and knowledge from our friend Kevin Schneider of Schneider law we will go ahead and get started with a prayer in the name of the father and the son holy spirit amen God of life and love you've given me this child are for this little while my heart is weld with joy and Thanksgiving anticipation and anxiety I'm it's a longing to be together as we have been until now these years of growing up has moved so quickly so many things left undone so much left unsaid so much I still hope to give to my child who is taking this new Step In the Journey of Life help us as we reshape Our Lives to reflect its new reality show us new ways to be present to each other in love and entrust give me patience and help me to remember that my child is establishing new routines and freedom routines different from my routines all my fears strengthen and protect my child in the midst of call Justin Temptations with surround all students at greater courage that I myself may have had in standing for your truth against compromises of Faith provide good friends worthy confidants for my child during this next chapter help me to give support and confidence to discern how I am needed now and to pass on in my love a measure of the strength and courage you've given me in the gift of parenting Father and Son and the Holy Spirit amen okay so as I said this is one of many webinars offered by Mater Dei as part of our endowment program we have a whole network of trusted professionals from attorneys financial planners Estate Planning and we just want to give you guys some insight some free education to help you best serve your families and prepare for your futures and if this comes around preparation for the future of modern day in building the endowment which will ensure that future generations of monarchs are able to enjoy the same education that it's getting now so if that's a consideration in your future we would greatly appreciate it with us is Kevin Snyder Snyder lockheed's I'm hopeful a future monarch of three and has presented on this topic a few times for us so I I'll turn it over to Kevin to share all the insights thank you Kevin thank you Captain Kathleen I really appreciate the opportunity to speak with all of you this evening about a very important topic that sorry I apologize one quick thing there is a q and a button at the bottom of your screen at you can go ahead and post questions throughout the webinar and I will keep an eye on that and then we can ask them all of Kevin at the end of the webinar and we will do our best to keep this right to 1 hour Kevin's got this all dialed in by now and will hit those questions at the end and we should have plenty of time. Sorry about that thanks no worries I think you're right Gatlin been able to keep this to the Power Hour Allison Bergeron likes to call it and it's chock-full of good information and we always get some great questions to really do encourage you to use the as you have it as you have the thought in your head the question your head please dump it in or else what happens to me is it that floats away and Kathleen a moderate that would make sure that we Circle back at the end get all your questions answered on this my name is Kevin Snyder I'm in the state planning elder law attorney in Irvine California at my own Boutique practice with a my awesome wife Carolyn at that we started to help protect families and what things happen in life that we don't plan for and I'm so as I mentioned that this topic tonight is really near and dear to our hearts because we have we have children of our own words but we also have come from a very large family and we have is the nephews that I've already graduated from college and currently in college right now and they're at the age that your your children are and we started this program years ago because it was affecting Scituate perfecting your own family and so I can share my screen as we go through the evening here in the presentation so the topic tonight as I mentioned it's about something that we call the young adult emergency what I hope to accomplish tonight is for you to learn why this type of planning is so important for your family for your child in order to do that you're going to know how the law works and see what really can happen if you don't have a plan in place and when life happens and we want to share with you what you need to do to be prepared and more importantly what your child needs to do is be prepared and how you can get there so we're going to talk about where your point is we're going to share with you where your point B needs to be in it how you can get there or not so like I said there's a lot of information here. So we we hope that you have a you're able to have some great questions this is going to be recorded So if you want to cycle back and watch it again you'll have that opportunity as well your speaker who's giving you this information and why is that I I'm here tonight and I have the three future monarchs that are in the middle that's our home team Connor Ryan Madeline 1110 in 8 years so we're getting closer to where you guys are right now with your family's but I can please mention come from a larger family that you see here and there's a number of already called graduates and current a graduate and while we had already established our practice and and we're helping other families with their Estate Planning and of course didn't occur to us that when somebody turns 18. They might need some a planning as well working with other types of families but when our family started aging up into that category really struck her first nephew went went off to college in Oregon what would happen if something happened to him now the course it's an interesting question because what would happen if something have them here in California never mind going to Oregon but the fact that he was going away really triggered that conversation and concern and so we work with with fine within our own family we took that model out into something that I want to share with you if you later but it's something that is affected us personally as a family and we want to extend it out to the community in the Monterey family about what has worked for us and how we've been able to help number of Family Circle Orange County with children under 18 in in a little bit older and certainly modern-day families have a a team that is great Mater Dei including a new addition to our team Jenna music who is a modern day in the modern day family herself so that's how it's not a law team in person people and we also have a conference center staff as well so keeping to our agenda I want to share with you why is this planning so important and the reason is is life happens when we're making other plans just like the that the quote from John John life is indiscriminate so we can think and want and hope that his parents are children are going to a 16 and bad things are going to happen to them for a very very long time of course you think that about ourselves is very difficult. to address issues immortality in the bad things that happen in life enough bad things that happen that we hear about it's nice to take a break from that and not really address it for ourselves and certainly for our children we want them to have a bright future in your children are launching off those that are still at Mater Dei but certainly those that are just graduated in may have recently graduated and then last few years are launching off and into Bright Futures and we only hope for the best for them but life happens I'll make other plans though the question is are your children going to be prepared for that are you going to be prepared for that you always want to protect your child no matter no matter how old they are as a parent of course you want to be able to be there to support them and whatever their needs are and you've been doing that but the question is who is will you be able to continue to do that moving forward in life was we're going to learn tonight that there is going to be an interruption legally speaking in that plan why you're always going to be a parent and you always want to be a parent is protecting your child and from the bad things that can happen in life you're not always going to be able to legally be their guardian and and question becomes what happens that situation so this is critical because many of you on this webinar right now your children are already 18 or you have children that already 18 and certainly critical for those are on this webinar the children will be 18 soon as soon as your child's birthday happens and become a team they are now an adult and they the laws are going to treat them as such and they're going to treat you that way so what are these laws and that I'm talking about what wire what would happen and I like to do debrief a little bit about that so what you need to know about the law first we use the phrase young adults and we call our program the in adult emergency planning colloquially talk about young adults but there's a legal definition of an adult in California an adult with somebody that turns 18 that's why I've been referencing the age of 18 that is true in most states in United States with the exception of Alabama Nebraska where the legal age is 19 do you know where you're going to your child's going to be of course and what state that you're in but pretty much when you're 18 and United States you are a legal adult now we have it's confusing cuz we a different ages such as 21 the legal drinking age but that is you're already an adult for several years and that in that situation so for your children here in California Once you turn 18 now adults what that means legally is that the laws apply to them just like they apply to you from the standpoint of what they can do the ramifications of and consequences of actions in with the law requires of them as far as responsibilities and what what you can do on their behalf and what I mean by that is that you don't know why tell the parent legal parent you no longer have a legal ability or right to make decisions for them once they turn 18 because it's there now no different in the Law's eyes and any other individual don't you can't make decisions for your name I just because you didn't know them and you can't make decisions for your parents or your siblings or a fact you can't make decisions for your own spouse simply because you have a certain relationship with them in the same goes are your children now they are now considered individuals and there are also a number of privacy laws that also protect individuals information so your child now has a legal of for you to make decisions for himself or herself and nobody else does that includes parents the problem of course is that well now you how do you spell individuals walking around in what what's going to happen if something happens to them and they're no longer able to make those decisions of whether it's an accident it's a nonsense of an illness is an untimely death what happens in those situations when our children could no longer vocalize their intentions are wishes and you want to step in and be able to make a decision or be able to do something that's protecting her get some information what can you do in those situations the way the law works unfortunately like I said only and only your child now has that decision-making Authority and if they haven't planned to I do anything to give you any Authority during life then what happens if their person falls into court and what I mean by that is that you would have to go to court and whatever state or jurisdiction they were in in order to petition the court to be given the legal authority to act on their behalf in California we call this a conservatorship and maybe you may have heard that term you know that term down a little bit more intimately unfortunately and it's a court process and very strange because you're asking the court to give you the legal authority to act as a parent apparent that you've always been up until this point and it's a proceed that doesn't happen overnight and like many corporate meetings Time Is Not Yours its the Court's time and it and it takes is a lengthy process and of course now during the pandemic all the core processes of slowed and their me the last thing you want to do is be in a situation where you're having to go to court in a crisis do it be able to ask the judge for permission and in order to be able to make decisions for for your child and that's what happened to your child that actually can happen to you if you haven't designated anybody to act on your behalf people would have to go to court to get that legal Authority because there's no automatic legal Authority based on relationship in life or in death so what can you do well fortunately the law allows for something to be done where an individual person can establish a list of people that can act on their behalf I typically you might hear the phrase powers of a and often times we talked about that generally oh I have a power of attorney for my parents so that I can step in and make decisions and care for them when they get older and perhaps have an onset of dementia I ordered more senile and they just can't do things for themselves that's a lot of times things of course I hear in my practice but we also hear just and in conversations with people comes up or somebody might give a power of attorney to starting to act all right I gave my agent to power of attorney to to Contracting and enter into negotiations for me what that really is is in agreement that you're saying that this other person can make these types of decisions in these certain circumstances there is no Universal Power of Attorney so just simply say I have a power of attorney for this other person now I can act on their behalf in any situation in any capacity for any certain things my happened there is not a universal power of attorney isn't this magic document that applies to every scenario I see your your child in the planning that they can do just like any other legal adult is to establish appropriate Powers of Attorney and really falls into two different categories one is a financial and legal power of attorney and the other deals is often called a medical power of attorney so think about it in two different bucket the financial legal power of attorney is often referred to as a durable power of attorney and it's called the durable power of attorney because it's saying that no matter if the individual it has is bright mind or they have become incapacitated This legal document will still be effective it will be durable just like tangible thing might be able to be durable and survive a thrashing or something like that Emily is going to survive any sort of situation in regards to a person's incapacity so that type of power of attorney only deals with financial and legal types of decision so man mint of bank accounts or policies or contracts and what kind of contract can your child enter into a cell phone contracts credit cards they might lease department purchasing a car lease a car are these are all types of contracts that we deal with on a daily basis so the financial and legal power of attorney the durable power of attorney will allow a person give somebody else a coexisting authority to act on their behalf that means that they're not giving up their ability to act but they're they're saying hey this other person can also act instead of me I don't have to be around they can act to make those decisions but I also still retain the ability that that that's golden the mediate power of attorney so means that the authority you have to ask for your child with the immediate type of Financial and legal Authority is one called a springing power of attorney which is is the same type of authority to act in financing for financial decisions or legal types decision such as filing a tax return but it only triggers if the person your child in our conversation tonight is incapacitated lacks capacity is not at 8 plus not have the cognitive ability to communicate or be able to make decisions or care for themselves a doctor has evaluated them or multiple doctors is evaluated them in rendered an opinion that they can no longer make those types of decisions and only in that situation would you be able to then be empowered to act by these legal. That's a springing power of attorney and people have either one kind of depends on the situation there's no right or wrong in which one is better or worse it really depends on the individual circumstances and what the wishes of the people are Vanessa Financial legal power of attorney in in only the people named in that document can act so again it has nothing to do with you the relationship or oh my child said I could do these things if this happened and needs to be in an actual legal document that is properly created and executed in to be recognized in the state in which the person is trying to use it the other type of a power of attorney is a medical power of attorney here in California and we call that the advance Healthcare directive known by various different names across the country and you know what state you're in it might be a medical power of attorney maybe a medical proxy other states also adopt the healthcare directive language it is a legal document that gives the Authority for a person to make the decision and act in regards to the individuals person about their finances but their person in the medical decisions regarding treatments or care whether its end of life or ongoing throughout life any type of a medical Asians are decisions regarding what's going to happen to that individual individual person's body it is what's contained in the medical power of attorney so your child will wait for you to act on behalf of your child in the situation your child would need to have established as a properly executed power of attorney for the state that they're in that would give you the authority to act in situations where they no longer and it's also this type of document that your childhood Express specific wishes of how they would want you to act on their behalf and different circumstances that could arise those that end-of-life in emergency treatment for I'm going treatment of in situations where they may not have the capacity to act and not you know it's often times we think OG something like that is just for older individuals I sure it's when were talking about dementia which is certainly encouraging a growing number of people in our society simply because it's been recognized more but dementia isn't the only reason to have a Michael directive what if there's an accident and your child hits their head and has a brain injury or there's a temporary incapacitate I had a client fall down the stairs and they were out of commission for three months in the hospital in and out of Consciousness unable certainly to manage things and take care of themselves Unfortunately they were able to recover into a point where they can now manage things on their own now for that time. They weren't able to imagine if that's your trial how are they going to be able to manage their care and who's going to make decisions over the type of care that they might need if there's no legal Authority so these are the types of things that are handled in in the Health Care directives and these are the types of portable Powers of Attorney that are going to be important to recognize last will and testament often is a phrase or a nut legal document too many people I heard about the why am I bringing this up here in the context of talking about your children know what do your kids have that they would need to have a last will and testament never mind the fact that we again we want to be both turn their bright future and don't like to think about the end of their life when would life was just beginning and so what's the purpose of a young person having a last will and testament and it's true and starting out many young young call might not have much by way of well-worth are things that are worth anything different Generations down the road other than perhaps our parents or grandparents generations with the heirlooms and things about had sentimental value we become a society that has moved away from that and certainly when you're younger you don't have those types of items that you might want to ensure go to individual the last will and testament for a young person is more powerful than that  is not about well if we're the parents it's about being able to manage the circumstances that follow the untimely death of a child there are a lot more the things that your children own and you may realize and that you might realize that you own and that's because we all have acquired digital assets digital assets are things like email accounts social media accounts of any sort of data-driven information whether it's on our cell phones or iWatch has any sort of subscription accounts we have places we have digital rights to photos music things like that all that are actually centered in the legal space to be in as much of an acid as your bank account and what happens to those things after somebody passes away if your child passes went on for some time late in early how is like when you get managed our how are you going to be able to access information that you might want to obtain in any of these platforms or close them out or deal with anything online I never mind having to deal with like your child may be having a bank account they have on their own or or something else that is in their own name or dealing with a contract that they entered into now those power of attorneys that you're that I talked about for the financial and legal power of attorney upon the death of a person no longer work they cease to have legal Authority because the person is no longer a lot their effectiveness is only during the person's life so in order to carry out similar responsibilities legal authority to act on behalf of a person who died you're going to need to be designated as an executor in there will it affect its go important for your child to have a will in order to designate you as an executor in California we called them personal Representatives cuz we want to be different but means the same thing as an executor is a person who's in charge of the story to act for somebody who has already died so that's as we're going to hear is going to be in an important document that people have found out the hard way unfortunately what happens when you don't have that and and when you don't have things as I mention some problems with the probate court or conservatorship conservatorship is a proceeding when an individual is alive and they're trying to get authority to act on their behalf either for financial legal or medical reasons and probate court is the court in which you would have to go to in order to petition the court to be your child's executor after their death do in both situations if you're in court pleading that the judge to give you the legal Authority that one of us think that of course is the parents are showing up that the court would be open to granting that Authority not a problem well yes or no and it really all depends where are the outcomes in court or not what not determined by you that determined by another individual and they may decide and the interest of in their minds of of Law and Equity that they are going to assign in neutral individual called a professional fiduciary instead of you in order to make certain decisions so just because again you have this close relationship with your child you were legally mom and dad or their legal guardian otherwise I have raised them that doesn't mean that definitively that you're going to be appointed by the court nevermind even having to go through the process but that you're even going to be given the legal Authority in the end it could be somebody else and that's it it's a slow process and I can speak to hear in in California even before pandemic it was a slow process a month to go through a conservatorship proceeding now during panda and we are sending out a year to finalize a conservatorship longer for probate court and if your son or daughter is not in California and I say they moved out of state to go to school and you're sick authority authority from that state and in order to act on behalf of your child if they are physically in that state and having to deal with that other states legal system and so again back of course stressful only and costly financially is now you're going to have to seek out legal counsel in that state and maybe in both States in California and that the other state and which your child is when the events occur so weak because are so limiting we want to make sure that we're well plant the last thing I'll say is on privacy laws that's the other thing that you're going to want to consider I need to know about as a parent you're not entitled to information either from school or from doctors of regarding your children and some of you have met already experienced this now because some of those laws pertaining to two teenagers and I when it comes to medical information or mental health information certainly moving forward when they turn 18 the privacy laws are going to protect their information medical and data from being shared with you again no matter that your mom or dad and at the same time those same laws at your data and medical information and on the medical side we know this to be the HIPAA Law Office of federal law in California has its corollary Most states do and it affected acts I'm very very soon early so you're helping from and is protected and medical treatment providers cannot just willingly give out that information information is simply that your patient even now they can't willingly give out I want to talk to you at a parent it was very frustrated because they had sent their their child to a camp for the summer and it was in between high school and college and they just want to get information about what was happening with him in the camp wouldn't give out there information because of citing privacy laws and then they were very apparent was very frustrated because where they were paying for the camp now but nonetheless the camp was following the law and without any signed waiver apparent couldn't get the so it's something that you going to want to consider is being not just having these legal authorities to act on behalf of your child but having the the important requisite waivers be able to get information that will best inform you of how to act on behalf of your child otherwise you're going to have to try to go to court in the situation and it in order to defeat the privacy laws which has been very difficult so that's a background of the law I can spend a lot more time on that but I want to move along to share with you some stories that we have unfortunately come across in our in our practice in our personal lives that highlights the concept that we talked about and I share with you that this evening so what really can happen without a plant and many of you may remember, the quintessential on a story of Terri Schiavo I'm back at you in in the 90s the present when I share this presentation and younger people are around course they're there isn't a laughing memory who carries travel is but I'm sure you all remember at least the name maybe not necessary the story which is why I like to share it with you briefly. Schiavo is remembered for being on life support for many years and her parents and her husband fighting in court over whether or not Gary should be withdrawn from life support what her true intentions were and this is a 15-year legal battle that went all the way up to the United States Supreme Court ultimately the court sided with Terri's husband who would let me with you or from life support but what sometimes has lost overlooked and then then Terry story is her age she was 26 years old when the she had she had a medical episode that basically a mini-stroke that shot of oxygen to her brain and that rented her in the arguable state that she was in which was depending on what side you were on the legal battle she was in vegetative state or not but she was definitely as the picture in the picture, toes and a very thin and seemingly non-responsive I'm not able to communicate and being kept alive officially on a machines and ventilator so this quality of life was something that her husband after I realized that was going to continue on indeterminate Lee and it would and it was his belief that Terry wouldn't want that the parents believe that Terry was still able to communicate through some body movements and couldn't believe that her there their daughter wouldn't want to continue to fight I hope that she was Sunday more absolutely revived and now the end of the day had Terry had set up her planning and put together a medical directive she could have easily designated to act on her behalf but it was going to your husband or parents and what order of who had legal Authority and describe what her decisions would be in situations like like she found herself where she was comatose or being kept alive artificially it would have been very clear and Terry and family would avoid that long legal battle and her wishes could have been fulfilled from the get-go but of course because she's only 26 likely didn't even think that she needed something like this in place or maybe didn't understand how the laws work when the fact that her her husband wouldn't be able to make those decisions necessarily so it's it's a Kostner tail over the confusion that can occur the moral of the story is that with Terry there was a confusion over her true Healthcare wishes even among the people that really knew her best cared for her an interesting thing is the sad thing is set the parents and a husband got along initially they there wasn't any animosity in the relationship while Terry was alive or even afterwards it only that the rift only occurred a few years down the road when the husband didn't want to have cherry maintained on life support any longer because it was a poor quality of life and that's when the relationship in the big rift occurred so easy to say I carry my sofa call Flow everyone will get along and rally to make the decisions on my behalf we don't have any conflict in the family and of course the people that love me best know we both think that's right but that's not what it was and of course and Terry situation we also have Kevin story which is one that the modern-day family's Topolino's very intimately the story of Kevin Hogan who who died unexpectedly while off of college sophomore College in South Carolina and at the time that it would be the events were unfolding and he was the medical crisis was happening a his parents actually were there very good relay the information in the story and some of you may have heard it directly from them their big Advocates were planning and of course getting information about regulators and also life insurance the big Advocates about making sure the parents and kids and families are planned and so there they they speak a lot and so some of you may have heard or the street from them what the story that they share his house that they were not too far away East Coast action by happenstance when this all happened but they didn't get information about what was happening to Kevin for a number of hours after he was rushed out to the hospital cuz they didn't have the information but because of the hospital wasn't sure if they can give out the information or let them know what was going on and so sadly Kevin's parents it was a very long time before they were eaten by his side at the hospital and then when they got to the hospital they were met with resistance from the from the hospital staff and giving them any detailed information about what was going on with Kevin other he was there and they couldn't foresee him it initially and they they weren't able to get the information why because they're there are Kevin didn't have any waiver that he had signed before he haven't been have any legal documents that said hey Ma dad can act on my behalf legally ends in situations of emergency or from medical decisions or to get information about me medical and health otherwise protected health information so none of that was a Alamosa. The hospital was citing privacy laws and of course we all have had experiences maybe with a Good Samaritan Hospital or Medical Practice information than they should have. But that actually is against the privacy laws and I can tell you in the medical field they are very reticent to do that because of fear of the litigation and lawsuits that can happen if after they're found out for violating those rules so more often than that you're going to hit a brick wall looks like Kevin's parents in addition after Kevin died they wanted to access his phone in order to get warm pictures get contact information for his friends let them know what had happened maybe even get a little more information about what happened and what led him to die so unexpectedly trying to figure out a figure that out Kevin wasn't known to use any drugs or the bad lifestyle healthy well-adjusted young man and so do it and they want to get more information that would put them in for house to and something the trigger to is that but they couldn't access is wrong and they didn't know his password and and then cell phone company wasn't being helpful of course because that data was protected information and they cited privacy laws I'm selves that protected that data and they couldn't even give it over to the parents of a deceased person and so it was a very challenging and heartbreaking and it for them in that regard Ryan story involves a car accident and Brian going out just to run a simple errand locally and getting in a car accident and being rushed to the hospital in the that's not being notified what happened of course when Brian doesn't come home to get worried and concerned what happened to Brian and not responding to calls on cell phone and they have no idea that he got his car accident well I ended up calling around to a number of hospitals eventually locally fearing the worst and they did find eventually where he was at the hospital he was taken to and then they were able to go over there but this was number of hours later I'm after the accident so similar to Kevin's parents they weren't notified originally that there was an emergency a medical emergency and so have there been a better plan in place of the first response there's an emergency room could have had the information at hand to contact Ryan's parents to tell them that something had happened and and and also had the information that they needed to be able to share what happened to Brian and and work with the parents and get them over and now the parents be able to be more fully informed and and have an ability to act that story is not one of any sort of medical tragedy or death but it has to deal with it and and a problem problems that can occur to young people who just aren't educated or are well-equipped and maybe even mature enough to handle some of the financial decision or some of the choices that we have elbow and light member I told you when you're 18 you're legally an adult which allows you to enter into a number of different types of legal contracts including opening credit whether it's through a traditional credit card company like Capital One or you go to a store and they tell you all we have our credit card in your able to get x amount percent off your purchase if you just sign up or you're on college campuses will often have a number of vendors that are there just that are giving away free t-shirts and other trinkets in order to entice people to sign up for things summer Witcher or credit cards or a cell phone plan things like that and easily a young person could find themselves mired in debt what happens in that situation when parents want to help and step in like they did in the story of Beth the best parents wanted to step in and help her because now she was lost you can no longer advocate for herself because she was overwhelmed when she was at school she had racked up a large amount of debt thousands and thousands of dollars and the parents wanted to step in to talk directly with the credit card companies a sister negotiate do all these things but they didn't have the ability to Advocate and I had become despondent and depressed and was decide you just ignore the problem and not address it and not and not include her parents know if only the styling ended up in that's having to file for bankruptcy a person that at her age which was in her in her early filing for bankruptcy was something that was very harmful for her date on her credit for 7 years and affected her ability to apartment eventually I lease a car purchase car is very damaging for her in her parents had they had the right legal authorities could have stepped in and acting acting on her behalf much earlier remember my my client they were talking about a medical situation with my my client. down the flight of stairs help himself in any situation because I had a rent to pay other bills to pay things to manage in his day-to-day Financial wife that he needed someone to be able to act on his behalf fortunately he had that planning set up and then someone could I do that so that he didn't fall into debt or things were at the collections it wasn't some sort of other catastrophic consequence but he had a power of attorney that was able to take care of manage his finances for him while he while he was in the hospital recovering so these are a number of stories things that can happen to people in general but certainly young people and I share that not to scare you but just to help you be aware of the situation so that we can actually aware and Britain Embrace of reality of life I'm going to have to present ourselves we can better prepare for them so as we we say here in the saying goes you know you plan for the worst and hope for the best and you don't want to be in a situation where the worst has happened but you haven't created a plan so what is that in a planet were talking about when I started off the our time tonight sharing with you that we had created a program called the Young Adult emergency plan and now I want to share with you what that program is I told you for the laws you heard what can happen and here is what you can do what your child needs effectively is what is in this young adult emergency plant their four pillars with the rapper around the room for me in color what are the legal documents that we talked about tonight Advanced Healthcare direct long with a hippo weigh per a durable power of attorney and which type while we work we work that out with you and your child a last will and and that's all wrapped around the medical emergency car that you see here on on the bottom left of the screen this is the emergency response system so if you think about Brian story on story where and the parents were ready form that's because there wasn't any emergency response protocol in place will this emergency medical card stays with your child in their wallet and you actually get a copy of it as well and the way it works that if there is a medical emergency crisis the person that is the first responder or the emergency room at the hospital is able to identify who your your child is the train of course persons not able to communicate to look for ID and you keep the medical emergency card next to your ID now they can they can find it and they can get information off the front of the card and in the back side of the card gives instructions of how they can access a cloud account that contains more emergency contact information and instructions as well as legal legal documents Advanced Healthcare directive a waiver do in an emergency in the situation Brian or Kevin it had there been in a medical emergency card I present the the hospitals would have been able to contact the parents immediately and as as soon as the accesses information on the account actually goes out to all the emergency contacts informing them who is who is accessing the information and how to reach out to the hospital in addition to the hospital having the ability to get a phone call I was also able to download formation print it out including legal documents or any other medical documents that you might include in there that might be important for your your child to share in a crisis some of your children might have pre-existing conditions that would be important allergies and free sample all that is contained with this card so that in the medical emergency the right people are notified the right information is gotten to the in the right hands quickly and efficiently and that particular type of a card is has an account that set up that is good for 5 years and legal documents are valid for as long as they need to be as long as your child wants them to be there is no he's out of that but this medical emergency card account is good for 5 years and and that's because of just going to pick up a nice round number that probably will comprise the amount of time your child may be away at that school and so the account and they card me she's coming with that time spent on it could be extended of work by your your your child with you later than that at least for the next five years want you to have the assurance that if there's an emergency you're going to be able to be notified and avoid any of that crisis like I said you also get a card so if you needed to access that information yourself to download the the medical directives yourself you always have access to the card to do that access the name of the cloud account as well or two maybe add something to the car to cut that would be important for your child to have in there because we all know how our children might be smart and well-adjusted people might not necessarily this agent might not know be diligent to I do things that we tell them to do like oh and make sure that you add this to this account so gives the parents access to the account as well to be of further assistance so I'm there's is a lot to think about and putting these types of documents together so we keep the documents again or hear there's a lot to think about and doing that and what we wanted to do is in and we do not practice normally is to help people not get it over with my all the decisions and I'm and what happens with overwhelming so we don't take that first step forward or we don't complete the project we really want to be the guide in your family to help your child be able to understand what they're doing understand the options are and understand what the ramifications of certain decisions are for them and for you and help guide the family meeting most of our meetings with our young adult clients include parents and it's a wonderful opportunity in conversation I had one father telling me that it was the best part of the whole experience of course they have the the peace of mind that they have this young adult emergency plan in place but even better than that it was the first adult conversation he was able to have with his daughter in found out to be a very very wonderful experience and in an eye-opening they were able to connect as adults so we're here to act as your legal counselor at law to all of the different decisions and choices I really out there because it's not very it's not straightforward at all so how do you get this in place it's really is like a toggle button be as easy as 123 use schedule a time to meet with me you're at the office or right now we're doing a lot of Zoom meeting is very convenient for you and your children to be on Zoom or even a phone call that's old technology some people like that we have that capability schedule a meeting we send you material for you and your child to review give you a little bit more information and education to get you prepared for the design meeting which is with one of our attorneys isn't mentioned and so you get to meet with an attorney to go over this. your guide through this process to set up these these documents and work through the a discernment decision-making and then the third step is to sign and notarize the legal document going over them one final time and then the legal plans created can you receive at the medical emergency cards and in the mail after work so it really is easy as 1 2 3 from a Time perspective it takes about 2 to 6 weeks for the process to go through two weeks is the quickest to get things together to go through the discernment the guidance and preparing the documents for Signature and afterwards to get the the cards prepared in the mail about you that takes about three or four weeks not to get you after so all-in-all if a raccoon is quick as possible for you to have legal documents signed ready to go and the emergency card is going to be processed total I share that because sometimes we get phone calls or going off to college tomorrow and we need to get this done can we do that well we can get the process started but we're not going to be able to get the whole thing done before your Chacos off off the school so now is a great time to do that since before still the home and they not ready to go out yet you for sports until filter in July we can we can do that course we need to do it work remotely we can but naturally it's a lot easier when people are in person and what's the your investment for all of this this a plan for our clients is the $700 cost of investment for it, because we have a wonderful relationship with Mater Dei we like to offer a discount for you for your current modern-day student or recent graduate from this year of $200 so is a $500 cost of investment if there are any alumni in your family as far as other children graduated already and your past or you have siblings are not Mater Dei students now then we offer another discount $600 crossover in basketball so is Allison Bergeron likes to mention know this is kind of looking at the span of five years is an investment $100 a year to protect your child allow yourself to continue to act as there are legal legal guardian while they're away that's my presentation is this evening I want to make sure that we leave some time for some questions and answers and puny so if there are any questions that any of you have please put them in in the queue in a box and I'll be happy to address them but here is some questions that I've gotten in the past during the presentation and so while we were going through some some questions in here I'll just talk about some of these what's the earliest age my child can get one of these plants and it really is the age is 18 when there are legally an adult so that's the earliest that they can actually have this plan in place in fact we have clients and have organized it says on their 18th birthday they're in the office and they're they're signing the documents certainly can get the planning started before they're they're 18 but you can't effectively sign a document so your child can effectively signing documents into other 18 what if my child's going to school out of state road country great question if they're going out of state we want to know where they got your child's going to be Stateside we can certainly Taylor or creation of documents to whatever state is there going to be in most so shortly what documents that are going to be effective in California and wherever your child's going to be so we asked for that information so that we can do that if they're out of country then the documents don't have legal effect in other countries but they can be instructive in in a number in a number of countries if something would happen so it's not necessarily the event that you would be able to have legal backing but the number of situations in cases where other countries will honor a power of attorney authority to act on behalf of the child has established in those types of documents so even if your child's going to school out of the country is it would important to have this plan in place certainly when they're home visiting or return from school but even if they're in that in that other country in addition know if they're in that other country you're also going to want to find out the laws and rules of backcountry also that you can also be best prepared how long are these legal documents good for are effective and they can it be changed is this something that my child standing up for the rest of your life yes or no or if they can be changed your child cannot effectively changed when they want to without it there legal documents in if their life circumstances change and they want to change them they can, and of course our relationships are going to change over time he's going to be new people that come into the life that they might want to be decisions for them instead of you later on like it when we get married and so it likely there's going to be change over time so these aren't things and decisions that are set in stone but they're certainly from now and so they're effective until your child new documents and and wants to create new documents those documents to proceed these ones these documents and they become in effect so like I like why I want to remind you that a medical emergency card is that account is it is a good for 5 years but the legal documents surviving Beyond so they the legal documents are good for longer than five years as long as we travel. What is my child's already left to go to school can you still get this process going or do we have to of course we have all lived in the zoom world in the virtual world for the last over a year even before that we were set up to work with with clients, and sometimes did with with children that were away at school or somewhere else Orange County in Easley facilitated I would encourage you and your children not to wait until they're back home to get the planning started if they're already 18 I will cuz we can we can do everything virtually and send them out documents for the notary notarization facilitated quite quite easily and what about the last question we get a lot in the presentations do I need to use a lawyer or can I just download these documents online we're told them out straight answer of course you can. Download documents off the internet offers a lot of things but you don't get in that scenario is the conversation the guidance in the over the different options and decisions and what's the language in these downloaded documents mean and what the ramifications and implications are of certain decisions in scenario so you're able to have that dialogue and support through through the process mentions a lot of things to consider so that's the benefit your children and you are going to get to work with real life a lawyer that you're going to be the last questions too and they're going to be able to guide you through a real person I in there that you don't get with new situations with downloaded documents sometimes it acts as Mad Libs for a planet as I call it you fill in all the blanks to make sense but just like with Mad Libs most often it doesn't sounds ridiculous and Lasting what you want legal documents that are going to sound an in Accra diculous in the situations that you need them to work so that's the benefit but I'm not here to say that you have to work with me just to be clear I'm here to give you the information about what the law is what the challenges and problems are if you don't have a plan in place for your child or your child is have a plan in place for you to ask for them and what available options there are out there so if you have an estate planning attorney that you already work with I have a good relationship with they can assist you and your family and I strongly encourage you do to seek out those resources if you're interested in working with us and be happy to help you as we have a number of other modern-day families over the years how you go about doing that if you're interested is right here and give us a call and I don't number 949-333-3702 I can send you can get this recording later and the slides as well and you can go to this link hearing and online if you like and it easy it is not easy for you to do that just need to go down to the young adult emergency plan design meeting option and you can pick a time that works well nothing one that works with your schedule again just give her office a calm be happy to help you so thank you for your time if you want to keep to the hour of the information of the presentation and hopefully I've been able to provide some good information for you this evening happy to be a resource for again in the future so thank you again everybody thank you very much Kevin you seem to have covered everything there's no questions in the Q&A thank you all so much for attending we really appreciate it and hopefully you some great information tonight as Kevin said this is recording so we will follow up later this week with a an email that will include all of this information from tonight contact information for both Allison myself at Mater Dei as well as Schneider law and then that can allow you another opportunity if any other questions come up and we'll look forward to sharing future webinars with you as well so thank you again so much and have a fabulous night
